TERM OF SERVICE
USER AGREEMENT
✦ By commissioning me (“firstolier”), you agree to these Terms of Service, including future updates.
GENERAL
✦ By commissioning me, you are purchasing my artistic service.
✦ I retain the copyright and ownership of all artwork unless otherwise agreed upon.
CLIENT GUIDELINES
✦ You may use this COMMISSION TEMPLATE or any format you prefer.
✦ If the quoted price is too high, you are welcome to revise your brief as needed. That is completely okay, even if you decide not to commission me at this time.
✦ Clients must provide all reference images for characters that have already been designed, along with a detailed brief.
✦ If a client would like character design services, additional charges will apply and requests will be accepted on a case-by-case basis.
✦ Clients are not permitted to change, modify, edit, or alter the delivered artwork in any way without the artist’s prior consent.
✦ Proper credit to me, firstolier, is required whenever the delivered artwork is posted or used on any platform.
✦ Personal printing is completely okay for non-commercial use.SIZE, ART STYLE & TOOLS
✦ Please let me know in advance if you have specific size requirements. My standard canvas size is 2480 × 3508 px at 350 DPI, though adjustments may be made for composition purposes.
✦ My artwork has a painterly style that includes broken line art, varied line weight, grainy textures, and intentional softness or blur in certain areas. If there are specific details you would like cleaned up or emphasized, please let me know beforehand.
✦ I also use color shifting, so colors may not remain fully identical to the original reference.
✦ My art style is not fully customizable, so please commission me only if you enjoy my existing artwork and artistic direction.
✦ I primarily work in Clip Studio Paint and may use copyright-free 3D references when needed.COPYRIGHT
✦ I reserve the right to sign and/or watermark my work.
✦ I may share WIPs or completed artworks on any platform unless an NDA is in place.
✦ Clients are responsible for protecting their character design rights when uploading to external sites.
✦ Cancelled or unused sketches may be reused by the artist for future projects.
✦ The usage of AI/NFT on my artwork is strictly prohibited and will result in all licenses being revoked immediately, including personal, monetized, and commercial licenses.NDA & PRIVACY REQUEST
✦ Unless an NDA is arranged during ordering, I reserve the right to publish WIPs and completed artwork on my social media immediately or after 3 months if requested.
✦ NDA means I cannot share WIPs or artwork.
✦ NDA fee starts at +30% of the total quote but may vary.
COMMERCIAL RIGHTS
✦ Non-commercial giveaways or VTuber fan art may qualify for reduced commercial pricing on a case-by-case basis.
✦ Monetized content license
This includes branding or platforms that generate revenue. Examples include streaming assets, videos, websites, VTuber, YouTube, Patreon, Twitch overlays, online novels, and similar uses where the artwork supports profit-making content but is not sold directly.

✦ Commercial & Merchandise license
This includes reproducing, distributing, or selling the artwork as part of a product, merchandise, advertisement, or commercial material. Examples include prints, keychains, apparel, video game assets, paid promotions, packaging, printed novel, and other forms of commercial distribution.

✦ You must credit me even if commercial rights are purchased.
Examples: credits page, video description, page description, or any clearly visible location.
✦ Using the artwork commercially without permission will result in a request to remove it or pay the commercial rights fee. Legal action may be taken if necessary.PAYMENT
✦ Payments are accepted upfront through Thai bank transfer, or PayPal invoice only, with all prices based in USD. (1 USD = 35 THB)
✦ To avoid accidental payments, I will personally send the invoice once your commission is confirmed. Please do not send payment before receiving the invoice from me.
✦ All PayPal fees will be covered by me, so the displayed price is the final amount you need to pay.
✦ Full payment is due upon signing the Commission Agreement before the start of work. Alternatively, for prices over 300 USD, a 50% up-front deposit is required, with a minimum deposit of 150 USD.
✦ Tips are not required but always appreciated!
REFUNDS & CANCELLATIONS
✦ Refunds are generally not permitted after payment, even if no artwork has been delivered yet, as time may have already been invested in drafting, planning, or idea development. However, a refund may be issued if I am unable to complete your commission for any reason.
✦ I may issue a full or partial refund depending on the stage of the artwork.
✦ Refunds will be issued only through the original payment method.
✦ If the client becomes unreachable for over 6 months, the commission will be automatically canceled without a refund.
✦ No refunds will be provided if the client violates the Terms of Service, behaves inappropriately, or is unable to communicate effectively.
✦ I reserve the right to cancel an order before payment without explanation.
✦ Clients must contact me to cancel a commission request.TIMELINE & DELIVERY
✦ Clients may set a deadline for their commission, which must be disclosed before payment.
✦ I may decline a project if the timeframe is too short.
✦ Clients have the right to be notified of any delays.
✦ Delayed responses from the client may affect the delivery timeline.
✦ Most illustration commissions are completed within 1–3 months, though delivery time may vary based on workload and request complexity.
✦ All dates provided are subject to change.
✦ Rush commissions may be accepted to move a project forward, starting at +30% of the total price.
✦ Current commission progress can be tracked through my queue.PROCESS
✦ After payment, the sketch will be delivered within 15 business days
✦ Deposit / Full Payment → Sketch → Sketch Approval → Remaining Payment → Line Art & Base Colors → Approval → Final Artwork
✦ I will provide updates at each stage for approval and continue once I receive your response.REVISIONS & FEEDBACK
✦ Minor changes are free if the missing or incorrect elements are my fault.
✦ Clients may request up to 3 major revisions during the draft phase. Afterward, only up to 3 minor adjustments within reason will be accepted.
✦ Any additional changes after this may incur a fee, depending on the nature of the change, starting at 30 USD.
✦ In the absence of feedback from the client, changes to the final piece will incur a fee.FINAL PRODUCT
✦ Once the request is completed, the full-size .png image(s) will be shared via a private Google Drive link or e-mail.
✦ Clients are responsible for saving all files, images, and digital data provided. I will preserve files for up to 3 months, but cannot guarantee against computer failure, accidental deletion, or loss.
✦I am not obligated to post your project publicly, and if it is posted, I may remove it at any time.
✦ Slight differences may exist between gallery samples and the illustration clients receive.
✦ I reserve the right to reject critiques pertaining to artistic skill or stylization if I deem the critique reduces the artistic quality of the piece.
CONTACT

✦ If 7 days pass without a response after you've contacted the artist, please consider reaching out through alternative methods. There might be an issue with notifications or a potential loss of the message.

✦ A possible schedule and queue of work will be updated after confirmation. In case I need further details or discussion I will contact you via twitter or e-mail.
✦ Additional characters
✦ extra details ( Clothings, accessories, body or specific race details). start at 300THB+ / 20 USD+ / per char
✦ 18+, R, Gore works will be charged extra. Starts at 500 THB (30USD)
✦ Additional detailed background starts at 1000THB+ / 50 USD+
✦ For commercial use, the price will be charged extra (75% of the total price).

Please note
If you refuse to transfer the payment, all sketches or any process of your work that you have received will be disabled to use and published. If you post them on social media, you have to take them down.
